Citing “transgressions” by the plaintiff’s attorney, a Massachusetts appeals court decided on Monday to set aside a $1.2 million jury award and ordered a new trial in a lawsuit stemming from a 2009 Green Line crash at Government Center, the AP reports.
The Green Line lawsuit came about after Scituate resident Colleen Fyffe suffering a neck injury in the accident, which sent 50 people to the hospital.
The trolley operator, Aiden Quinn, admitted to texting before the crash. The MBTA appealed after Fyffe was awarded $1.2 million during a 2012 trial.
