Parents of deceased race car driver filed a lawsuit against legend driver Tony Stewart, for his role in their son’s death. The parents blame Stewart’s volatile emotions for the fatal incident last year. Kevin Ward Jr. was racing at the Canandaigua Motorsports Park in New York on August 9th, 2014 when Stewart’s car bumped into Ward’s. Ward left his vehicle, apparently to confront Stewart on the track, but then was fatally struck by Stewart’s car. Though a grand jury decided against pressing charges, Ward’s parents are seeking financial restitution for Stewart’s alleged reckless conduct, gross negligence and the wrongful death of their son, reported ABC news. After the incident, Stewart, a three-time Sprint Cup Series champion, also known as “Smoke” issued a statement:
“There aren’t words to describe the sadness I feel about the accident that took the life of Kevin Ward Jr.”
Later, a toxicology report showed that Ward had marijuana in his system the day of the incident. His mother, Pamela Ward, told ABC that it did not affect his judgement. Instead, the mother said, “If Tony would have stayed low on the track and not gunned his engine and headed for my son, my son would still be here.”
